Dentro del trámite del proceso de la referencia la Directora Jurídica de la Fiscalía General de la Nación recusó al Magistrado Jorge Ignacio Pretelt Chaljub, invocando como causal el interés directo en la decisión.
La Sala Plena concluye que las apreciaciones manifestadas por el precitado magistrado sobre el doctor Eduardo Montealegre Lynett, en el momento actual no tienen injerencia en el debate, estudio y votación de la demanda, por cuanto el período para el cual fue elegido como Fiscal General de la Nación culminó el 29 de marzo de 2016.
En consecuencia, se RECHAZA la recusación formulada y se dispone continuar con el trámite de constitucionalidad.
